Terms of Sale
1. Who you are buying from
Nebrina Padel is a trading name of Nebrina Limited, a company registered in England
and Wales under company number 16972767, with its registered office at Office 707,
60 Tottenham Court Road, Fitzrovia, London W1T 2EW, United Kingdom.

We hold stock and fulfil orders from two sites: Western Bid Fulfillment Center,
Katowicka 9, 31-351 Kraków, Poland, and Blue30 Prep Centre, Great Stambridge Hall,
Stambridge, Rochford, Essex SS4 2BF, United Kingdom. Orders for Poland ship from Kraków
and orders for the United Kingdom ship from Essex.
In these terms, "we", "us" and "our" mean Nebrina Limited. "You" means the person
placing the order.
2. What these terms cover
These terms apply to every order you place through nebrinapadel.com. By placing an
order you accept them. Please read them before you buy; we recommend saving or
printing a copy.
We sell to consumers and to businesses. Where a term applies only to consumers, we say
so. If you are buying as a business, sections 9 (cancellation) and parts of section 11
(liability) do not apply to you.
We do not sell to anyone under 18.
3. Products
We sell genuine Babolat padel rackets and padel balls. We are not the manufacturer.
Babolat and Automobili Lamborghini are trade marks of their respective owners; we use
them only to identify the products we sell.
Product photographs are of the actual product but colours vary between screens. Small
variations in finish, grip and packaging occur between production batches and are not
defects.
Where a product is described as a limited edition, that description comes from the
manufacturer. We do not control the size of the run and do not guarantee any particular
number.
4. Placing an order
Our website invites you to place an order; it is not an offer. A contract is formed only
when we send you an email confirming that your order has been dispatched. If we cannot
fulfil your order we will tell you and refund any payment in full.
We may refuse or cancel an order if:
- the item is out of stock,
- there has been an obvious pricing or description error,
- we suspect the order is for resale in breach of section 6, or
- we cannot verify your payment or delivery details.
5. Prices and payment
Prices are shown in the currency of the market you are shopping in and include VAT.
The price you see is the price you pay; only delivery is added, and it is shown before
you pay. Business customers who need an invoice showing their VAT number should email
support@nebrinapadel.com with the order number. Delivery is charged separately and shown before you pay.
If a price is obviously wrong and you could reasonably have spotted it, we do not have
to sell at that price. We will contact you before doing anything.
We accept the payment methods shown at checkout. [Confirm the final list before
publishing: cards, Apple Pay and Google Pay through our payment provider, and BLIK if
and only if your gateway supports it — see the notes in shopify-setup.md.] Payment is
taken when you place the order. We never see or store your full card number.
6. Purchase limits
Rackets in the Babolat × Automobili Lamborghini BL.002 range are limited to five per
customer. We apply this per customer, not per order, and we may cancel and refund
orders that we reasonably believe are attempts to work around it.
These are allocated editions. We would rather five people got one each than one buyer
got the lot.
7. Discounts
Discounts are applied automatically at checkout on the terms stated on the site at the
time of your order. Current terms: 15% off the list price on a single racket, and 25% off
each racket when your order contains two or more, in any mix of colourways.
Discounts cannot be combined with other offers unless we say so. We can change or
withdraw a promotion at any time, but never after you have placed an order.
8. Delivery
We deliver to the United Kingdom and Poland. Current times, counted from dispatch:

Everything on the site is held in stock and dispatched the next business day at the
latest. Delivery times are estimates, not guarantees, and the courier can be delayed by
things neither of us controls.
Goods are at our risk until they are delivered to the address you gave us. Ownership
passes to you when we have received payment in full.
If nobody is available to take delivery, the courier will leave a card and follow its own
process. If a parcel comes back to us undelivered we will contact you; a redelivery may
be chargeable.
9. Your right to cancel (consumers)
If you are a consumer you have a legal right to cancel a distance purchase within 14
days of receiving the goods, without giving a reason. In the UK this comes from the
Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
in Poland from the Ustawa o prawach konsumenta implementing Directive 2011/83/EU.
We go further and give you 30 days. Our full policy, including how to start a
return and what condition goods must be in, is in our Returns and Refunds Policy, which
forms part of these terms.
To cancel, tell us at support@nebrinapadel.com before the deadline. You may use the model
cancellation form set out in the returns policy, but you do not have to.
10. Faulty goods and warranty
Nothing in these terms affects your legal rights.
If you are a UK consumer, the Consumer Rights Act 2015 gives you rights where goods are
faulty, not as described or not fit for purpose, including a short-term right to reject
within 30 days. If you are a consumer in Poland, you have equivalent rights under the
Ustawa o prawach konsumenta, including a two-year period in which we are liable for a
lack of conformity.
On top of that, every racket carries a two-year manufacturer warranty against defects
in materials and workmanship. We handle the claim on your behalf. The warranty does not
cover normal wear to the face or grip, or damage from impact with the glass, the floor,
another racket or the ground. No racket warranty covers that.
11. Our liability
We are responsible for loss you suffer that is a foreseeable result of us breaking these
terms or failing to use reasonable care. We are not responsible for loss that was not
foreseeable.
We do not exclude or limit our liability where it would be unlawful to do so. That
includes liability for death or personal injury caused by our negligence, for fraud, and
for breach of your statutory rights as a consumer.
If you are buying as a business, our total liability in connection with an order is
limited to the amount you paid for it, and we are not liable for loss of profit, loss of
business or loss of opportunity.
Padel is a sport. We are not responsible for injury arising from playing it.
12. Complaints
Email support@nebrinapadel.com and we will acknowledge within one business day and aim to
resolve within [X] days.
If we cannot resolve it between us, consumers in the UK can seek help from Citizens
Advice, and consumers in Poland from their powiatowy (miejski) rzecznik konsumentów or
the Inspekcja Handlowa. [Confirm whether you are signing up to a specific ADR scheme; if
so, name it here with its address and website.]
13. Events outside our control
We are not liable for delay or failure caused by something outside our reasonable
control. If it happens we will tell you, and if the delay is substantial you may cancel
and receive a full refund.
14. Changes to these terms
We may change these terms. The version that applies to your order is the version
published when you placed it. Material changes will be flagged on the site.
15. Other terms
If a court finds part of these terms unlawful, the rest continues to apply. If we do not
insist that you do something, that does not stop us insisting later.
You may not transfer your rights under these terms without our written agreement. We may
transfer ours if your rights are not affected.
16. Governing law
These terms are governed by the law of England and Wales, and disputes may be brought in
the courts of England and Wales.
If you are a consumer resident in Poland, this does not deprive you of the protection of
mandatory Polish consumer law, and you may bring proceedings in the Polish courts.
Returns and Refunds
1. The short version
Thirty days. Unused, in its cover or box, with the authentication plaque if it came with
one. Full refund including the standard delivery you originally paid, and we pay the
return postage.
If it is faulty, none of the conditions below apply — go straight to section 6.
2. Your legal right to cancel
If you are a consumer you may cancel a distance purchase within 14 days of the day
you receive the goods, without giving a reason.
- United Kingdom: Consumer Contracts (Information, Cancellation and Additional
Charges) Regulations 2013.
- Poland: Ustawa o prawach konsumenta, implementing Directive 2011/83/EU.
Where an order arrives in several parcels, the 14 days run from the last one.
We voluntarily extend this to 30 days. Everything below describes the 30-day policy.
Your statutory 14-day rights sit underneath it and are not reduced by anything here.
3. Condition
To be returned under the 30-day policy, a racket must be:
- unused — not hit with, on court or off it
- in its original cover or presentation box, undamaged
- with the authentication plaque, wrist cord and any documentation it came with
- with its protective film and labels still attached, if it had them
You are allowed to handle the racket as you would in a shop: take it out, look at it,
feel the balance, put it back. You are not allowed to play with it and then send it back.
If the value has dropped because of how you handled it, we may reduce the refund
accordingly, and we will explain exactly why.
Balls cannot be returned once the pressurised tube is opened, because opening it destroys
the product. Sealed tubes can be returned like anything else.
4. How to return something
- Email support@nebrinapadel.com with your order number and what you are sending
back. You may use the form in section 9, but you do not have to — a plain email is
enough.
- We reply within one business day with a prepaid returns label and the address.
- Pack it in the original box or something equally protective. A racket in a padded
envelope will arrive cracked and that is on you.
- Send it within 14 days of telling us you are cancelling.
Send it to whichever address is on your label. We fulfil from two sites and
returns go back to the one your order came from, so nothing crosses a border twice:

Our registered office at 60 Tottenham Court Road is a service address, not a warehouse.
Parcels sent there will not reach us. The prepaid label we send always carries the right
address, so the simplest thing is to use it.
Return postage is on us on the prepaid label we send. If you arrange your own
courier, that is at your cost and risk, and we can only refund what we receive.
5. Refunds
We refund to the payment method you used, within 14 days of receiving the goods back,
and usually much sooner. Banks then take their own time — typically 3 to 5 business days.
We refund the price you paid plus the standard delivery charge on your original order. If
you chose priority delivery, we refund the standard rate, not the priority premium: that
is what the law requires and we are not going to pretend otherwise.
Where a multi-racket discount was applied and you return part of the order, the discount
is recalculated on what you keep. If you bought two rackets at the 25% tier and return
one, the remaining racket is repriced at the single-racket 15% rate and the refund is
adjusted. The checkout shows this before you confirm a partial return.
6. Faulty, damaged or wrong items
Nothing here limits your legal rights.
If something arrives faulty, damaged or not what you ordered, email
support@nebrinapadel.com with your order number and a photograph. We will collect it and
send a replacement or a full refund — your choice — and you pay nothing.
UK consumers: the Consumer Rights Act 2015 gives you a short-term right to reject
within 30 days, and rights to repair, replacement or a price reduction after that.
Consumers in Poland: the Ustawa o prawach konsumenta gives you rights where goods do
not conform to the contract, for two years from delivery.
7. Warranty claims after 30 days
Every racket carries a two-year manufacturer warranty against defects in materials and
workmanship. Contact us rather than Babolat — we open the claim for you.
The warranty does not cover normal wear to the face, grip or frame paint, or damage from
impact with the glass, the floor, another racket or the ground. That is not a loophole,
it is how every racket warranty in the sport works.
8. Business customers
If you are buying as a business, the 14-day statutory cancellation right does not apply.
Our 30-day policy is offered at our discretion and is subject to the same conditions. Your
rights in respect of faulty goods are unaffected.
9. Model cancellation form
You do not have to use this. An email saying you want to cancel is enough.

Privacy Policy
1. Who is responsible for your data
The data controller is Nebrina Limited, company number 16972767, Office 707,
60 Tottenham Court Road, Fitzrovia, London W1T 2EW, United Kingdom, trading as
Nebrina Padel.
Contact for anything about your data: hello@nebrinapadel.com, or write to the address
above marked "Data Protection".

2. What we collect
When you buy something: name, delivery and billing address, email address, telephone
number, order contents and value, delivery choice.
When you pay: we do not receive or store your card number. Our payment provider
handles that and tells us only whether the payment succeeded, the card type and the last
four digits.
When you contact us: whatever you put in your message, plus your email address and
any phone number you give us.
When you use the site: IP address, device and browser type, pages viewed, what you
put in your basket, and how you reached us. Some of this comes from cookies — see our
Cookie Policy.
If you subscribe to email: your email address and whether you opened or clicked.
We do not knowingly collect data from anyone under 18, and we do not collect special
category data.

We also share data with our accountants and advisers, and with authorities where the law
requires it. We never sell your data.
Update this table before launch. Naming providers you do not use, or omitting ones
you do, is the single most common failure in a privacy policy.
5. Sending data outside the UK and EEA
Some providers are outside the UK and EEA. Where that happens we rely on the UK
International Data Transfer Agreement or Addendum, on European Commission adequacy
decisions, or on Standard Contractual Clauses. Ask us for a copy of the safeguards.

7. Your rights
You can ask us to: give you a copy of your data; correct it; delete it; restrict how we
use it; give it to you or another provider in a portable format; or stop using it for
direct marketing.
You can object to processing based on our legitimate interests, and you can withdraw
consent at any time — that does not affect anything done before you withdrew.
Write to hello@nebrinapadel.com. We reply within one month. There is no charge unless a
request is clearly excessive.
If you are not happy with how we handle it you can complain to a supervisory authority:

We would rather you told us first, but you do not have to.
8. Marketing
We send marketing email only if you asked for it, or if you bought from us and we told
you at the time that you could opt out. Every message has an unsubscribe link, and it
works immediately.
Advertising cookies that let us show you ads on other platforms run only if you accept
them in the cookie banner.
9. Security
Data travels over an encrypted connection. Payment card data goes straight to our payment
provider and never touches our systems. Access to order data is limited to people who
need it. No system is perfectly secure, and we will tell you and the regulator if there
is a breach that requires it.
10. Automated decisions
We do not make decisions about you by automated means that produce legal effects, beyond
the automated fraud scoring our payment provider applies to transactions. You can ask for
a human to review a declined payment.
11. Changes
We will post any change here and update the date at the top. If the change is significant
we will tell you by email or on the site.
Cookie Policy
1. What cookies are
Cookies are small files a site puts on your device. Some are needed for the site to work
at all — remembering your basket, keeping you logged in, stopping fraud. Others tell us
how people use the site, or let us show ads.
We also use similar technologies such as pixels and local storage. When we say "cookies"
below we mean all of them.
2. Your choice
Strictly necessary cookies run without asking, because the site cannot function without
them. Everything else runs only if you accept it in the banner.
You can change your mind at any time through the cookie settings link in the footer, or
by clearing cookies in your browser. Refusing analytics and advertising cookies does not
stop you buying anything.
Under UK law (Privacy and Electronic Communications Regulations) and Polish law
(Prawo telekomunikacyjne, implementing the ePrivacy Directive) we need your consent for
anything beyond the strictly necessary. That is what the banner is for.

Embedded content
The reviews section links to YouTube. If you click through, YouTube sets its own cookies
under its own policy — we do not control them. Nothing from YouTube is set while you stay
on our site, because we link out rather than embed.
4. Changing your mind
- On our site: use the cookie settings link in the footer.
- In your browser: every major browser lets you block or delete cookies. Blocking
strictly necessary cookies will stop checkout working.
- Google Analytics: the Google Analytics opt-out browser add-on works across all
sites.
5. How long we keep your consent
We record your choice and the date, and ask again after [12] months, or sooner if we add
a new category.

If we add or remove cookies we will update this table and the date at the top.
